- PublicationAn assessment of the legal and regulatory framework supporting the implementation of the National Integrated Identity Management System (NIIMS) in Kenya(2024)This study sought to establish the elements that constitute comprehensive legal and regulatory landscape for successful digital identity system establishment and implementation. Subsequently, the study sought to assess whether these elements were present in the establishment and implementation of the National Integrated Identity Management System (NIIMS) in Kenya. The study adopted a qualitative approach, data was obtained firstly, through literature review that provided background information to the study. Secondly, semi structured interviews were undertaken on purposively selected key informants. The study established that the elements that constitute a robust legal and regulatory framework for digital identity (ID) establishment and implementation include presence of a constitutional provision on the right to privacy; existence of a digital ID law governing the establishment of the system; amendment of laws relating to the registration of persons; existence of a data protection law; existence of an overarching law governing the digital economy among others. Largely, most of these elements were present in Kenya. However, the legislative approach adopted in crafting digital ID law in Kenya was wanting. This has undermined effective implementation of the NIIM system by among other things eroding public confidence in the system. The study concluded that effective operation of the system hinged on the existence of a robust and comprehensive legal and regulatory framework that will engender users’ trust in the system. In this regard, the study recommended review of the existing legal framework to ensure that it underpins both the foundational and functional aspects of the NIIM system.

Like the Empire, whose structures it adopted in great part, the Church drew its strength from its rootedness in the polis. As a consequence, being called Christian, throughout the 2nd century, was claimed by individuals from communities whose liturgical practices, clerical structures, even their canonical texts and profession of faith were different or outright in opposition. The history of the Church in the 2nd century is the history of this expansion of Christianity, the multiplication of these communities and the construction of a common identity. © 2010-2014 Cairn.info.
66 141 - PublicationEnterprise Content Management system implementation: Insights from the National Library and Archives of UAE(2023)This study aims to elucidate the key elements that contribute to the successful execution of an Enterprise Content Management (ECM) system. The insights provided are based on the experiences of professionals at the National Library and Archives of the United Arab Emirates (UAE) during their ECM implementation. An interpretive philosophical model, along with qualitative methodologies such as interviews and focus group discussions were employed for data collection. The participants included professionals from the UAE's National Library and Archives who played a significant role in the ECM system's implementation. A thorough review of relevant literature was also carried out to validate and reinforce the viewpoints obtained from the interviewees and focus group participants. The study discovered that comprehensive business needs assessment, detailed research, system compatibility, clarity of policies, and effective change management are vital for the successful roll-out of an ECM system. However, it's worth noting that the proposed implementation model offered in this study may not be all-encompassing. The insights shared are limited to the experiences of one archival institution, and the literature consulted may not cover all existing viewpoints. Despite these limitations, this research provides essential guidance, particularly to national archival institutions contemplating the adoption of ECM systems. It underlines the importance of ECM in effectively managing an organization's structured and unstructured data and emphasizes the need for due diligence during ECM implementation. Further research is recommended to explore the advantages arising from the successful implementation of an ECM system.

La confrontation de cette anecdote, inventée par Prudence, avec les conditions de la prostitution et les pratiques pénales en vigueur dans l’Empire entre le IIe et le IVe siècle, montre que cette scène, qui n’a rien d’invraisemblable, ne correspond pas à la pratique d’une condamnation à la prostitution. De telles condamnations ont pu être prononcées ; mais les pièces du dossier habituellement invoquées pour en attester la réalité invitent à conclure qu’il s’agit, la plupart du temps, d’une exposition dans le cadre traditionnel du procès (préparation du corps pour l’interrogatoire sous la torture) ou des suites du procès (mise à mort, envoi aux mines), occasions dans lesquelles le corps de la femme est mis à nu, outragé voire utilisé. De l’imaginaire de la haine au tyrannicide régalien de Louis XIII contre Concini(2017)À partir d’un échantillonnage du corpus de la littérature anti-conciniste, publiée entre 1615 et 1617, cet article montre comment les polémistes ont fait du libelle une fabrique de l’odieux en créant une haine publique. Concini devient le bouc-émissaire d’un ressentiment national tourné contre les étrangers. Le coup d’État royal puis le carnaval sanglant du peuple parisien contre le corps du favori honni marquent le passage d’une haine de papier à une haine brutale, d’une xénophobie politique de circonstance à une xénophobie légalisée et juridique. Louis XIII la justifie par son geste puis par les dispositions parlementaires prises contre les étrangers à la fin de la régence.
77 195 - PublicationLes passions haineuses dans les histoires dévotes de Jean-Pierre Camus : un théâtre didactique des corruptions humaines(2015)Les histoires dévotes de Jean-Pierre Camus, évêque de Belley, s'inscrivent dans la veine tragique de la « littérature saturnienne » de l'âge baroque mais s'en émancipent par leur facture dévote, mystique et morale. Elles mettent en scène la corruption généralisée de l'homme et de la cité terrestre que Camus explique en partie par le dérèglement indi-viduel des passions de l'âme auquel il consacra un traité. Invité à user et non à abuser de ses passions, le lecteur contemple leurs excès sur la scène de l'amphithéâtre sanglant qu'est le monde. Par cette méthode, la corruption des passions est guérie par un faire voir rédempteur de soi où le sujet apprend à se haïr, en haïssant le monde en lui. Invité à une action de ses passions contre la corruption du péché, le lecteur est rééduqué par une métaphysique du regard à se faire alchimiste, à métamorphoser la haine d' inimitié en une haine d'abomination. Cet apprentissage à domestiquer ses passions, au lende-main des guerres de Religion, se retrouve à la fois dans la spiritualité mystique, dans les théories de la monarchie absolue, dans les traités civils de cour et dans les traités des passions. Autant de réponses apportées aux maux de la corruption mondaine pour juguler la violence des passions humaines 1. Un jeune homme incorruptible aux vertus célestines, Cadrat 2, semblable à Loth dans la ville de Sodome, avait pour père un homme corrompu. Saint enfant, écrit Jean-Pierre Camus, Cadrat désirait faire son noviciat contre les volontés de son père débauché. Aux aspirations 1. Le substantif « cadrat » renvoie en typographie au carré de métal utilisé pour obtenir le blanc des alinéas afin d'ordonner la mise en page. Le carré symbolise traditionnellement la géométrisation du chaos par l'ordre. Ce prénom singulier semble donc refléter l'ordonnancement vertueux du chaos des passions paternelles par Cadrat.
53 41 - PublicationLibrary and information science and the positivist paradigm: Some critical reflections(2023)The employment of the positivist paradigm in Library and Information Science (LIS) research is commonplace, by at least those who have cared to declare their research paradigms, especially at masters and doctoral levels of their studies. Inspired by such widespread use of positivism in LIS, this paper interrogates the applicability and appropriateness of this paradigm as a philosophical bearing for LIS researchers. Although the thrust of the paper is to critique the applicability of positivism to LIS research, it is itself not a lampoon on the scientific nature of LIS, neither is it in the interest of the paper to challenge any researchers who have employed positivism in the conduct of their research in the area of LIS. Instead, it is a critical reflection on some of the glaring challenges of employing positivism in LIS research, and warns against falling into the trap of what the author calls “positivist paradigmatic sophistry.” The paper is not prescriptive or conclusive, but opens new opportunities for critically reflecting on the utility of positivism in LIS research, and a more careful use of this paradigm by LIS scholars and researchers. The discussion unfolds by first putting LIS into perspective by way of briefly tracing the development of the sciences through the lens of Comte. It proceeds by way of explaining the nature of LIS in order to put it into perspective and goes on to unpack the concept of a paradigm before zeroing in on positivism as a paradigm of research. The paper finally presents some challenges that are associated with the application of positivism to LIS research. It argues that positivism is largely incompatible with LIS as a social science and concludes by imploring LIS researchers to engage in a deliberative and progressive discourse on whether positivism is appropriate for LIS research.

The purpose of this article is to identify record-keeping challenges, opportunities and weaknesses that emerge from AI loose regulation. The research focuses on Sweden, Finland and South Africa, examining the interplay between existing guidelines, recommendations and legal structures at various levels. Design/methodology/approach The research adopted comprehensive systematic and scoping literature reviews, encompassing academic papers, reports and legal documents, along with an analysis of non-academic sources relevant to the study. This methodological approach helped to obtain a deep understanding of the evolving AI regulatory frameworks. Findings There is currently limited research that focuses on the impact AI deployment has on the management of critical records in government administrations. Also, the findings reveal that AI regulatory environment varies from country to country. The European Union stands as a noteworthy example of a comprehensive framework for AI governance. In contrast, South Africa, while at its infancy stage, demonstrates potential initiatives and policies at different levels. There is emphasis on the need to focus on co-operation, skills development and uniform regulatory frameworks. Practical implications This research holds significant practical implications for policymakers, government bodies and stakeholders involved in AI governance. It emphasizes how crucial it is to incorporate AI alongside a solid records management system. The study advocates for strategic investments in education and skills development to enable individuals to navigate the complexities of AI governance. Originality/value This research adds to the existing body of knowledge by providing an examination of AI legislation in e-government in the context of public records management. The analysis helps to review literature and other research materials across different geographical areas. The study explores the distinctive strategies used by Sweden, Finland and South Africa. 63 320 - PublicationThe need for a participatory recordkeeping system for children and young people placed in residential care homes: the case of Sweden(2024)
; Zimic, SheilaThis study demonstrates the need for participatory recordkeeping to promote the right of children and young people placed in Swedish residential care homes to record-making, to facilitate access to a complete record of their placements. It is further through record-making that the experiences of the placed individuals can be used to inform practice and policymaking. Currently, the placed individuals’ experiences of the residential homes are captured at the discretion of the residential homeowners and the social workers. A rights-based archival and recordkeeping paradigm would promote the design of records management systems with the children and the young people at the center and hence allow them to participate in the record-making processes which would give them a voice. Currently, records from the placed individuals, the residential care homeowners and the parents/guardians are sent to the municipalities through electronic and physical channels and in different formats such as SMS, audio files, and paper documents. These records are captured in the Integrated Children System (ICS), according to the guidelines of the National Board for Health and Welfare and at the discretion of the social workers. The authors therefore argue that recordkeeping systems should give all the involved stakeholders a right to independently participate in the record-making or the documentation process with the placed individuals at the center. It is the totality of the captured records that should give the placed individuals a complete record of their experiences of the placements. It should be the basis upon which the quality of care is assessed and improved. Two case studies were used to access the information management environment. The placed children should have a right to access all the records captured in the recordkeeping system to give them an understanding of their lives in the present and the future.27 - PublicationTowards Safeguarding Users' legitimate rights in Learning Management Systems (LMS): A case study of Blackboard at Sorbonne University Abu Dhabi(2022)This paper sought to establish the extent to which users’ legitimate rights are safeguarded in Learning management systems (LMS), specifically, on the Blackboard system, used for teaching at Sorbonne University, Abu Dhabi (SUAD) Firstly, users’ legitimate rights that must be protected were identified. Subsequently, the security and privacy guarantees afforded by Blackboard were assessed. Lastly, policy gaps and technological deficiencies undermining protection of users’ legitimate rights were identified. The study adopted a qualitative research approach and a case study research design. Data was collected through content analysis, document review and interviews The research revealed that to a large extent Blackboard, LMS safeguarded most of the users’ legitimate rights. However, the system is silent on some legitimate rights such as storage limitation and data sharing arrangements. Further, it emerged that Blackboard’s privacy practices are to a large extent informed by educational institutions using its products. The study concludes that safeguarding user’s legitimate rights is a collective responsibility between the learning management services providers and the educational institutions. As such, there is need for educational institutions using Blackboard and other learning management systems to craft robust data protection regimes.
